1. Acceptance of Terms
These Terms & Conditions ("Terms") govern your access to and use of the Fayetteville Artificial Intelligence website, forms, communications, digital products, and services. By using the website, submitting a request, purchasing a service, or entering into an order or subscription with us, you agree to these Terms.
If you enter into a separate written proposal, order form, statement of work, or service agreement with us, that document will control if it directly conflicts with these Terms.
2. Services, Proposals, Fees, and Payments
Fayetteville Artificial Intelligence provides services that may include Digital Sales Agents, websites or SmartSites, customer apps or app extensions, AI assistants, communication tools, social media content, AI phone services, marketing support, consulting, maintenance, and custom automation.
- Specific deliverables, pricing, billing frequency, setup fees, usage charges, timelines, revisions, and cancellation terms are described in the applicable proposal, checkout page, invoice, order form, or service agreement.
- Recurring services continue for the agreed subscription period until canceled according to the applicable plan or agreement.
- Third-party charges, advertising spend, telephone or SMS usage, domains, premium software, and other pass-through expenses are not included unless expressly stated.
- Amounts owed must be paid when due. We may suspend services for overdue balances after reasonable notice.
Preview designs or demonstrations are provided for evaluation and may be limited, temporary, watermarked, hosted on a test address, or removed at any time before a paid service begins.
3. Customer Responsibilities
You agree to provide accurate information, lawful content, necessary approvals, and timely feedback. You are responsible for verifying business details, pricing, licenses, claims, images, customer communications, and other material published or sent on your behalf.
You may not use our services to violate law, infringe rights, impersonate others, distribute malware, mislead consumers, send unlawful or non-consensual communications, or promote prohibited or abusive activity. You are responsible for obtaining and documenting any consent legally required for calls, emails, recordings, or text messages sent through your account or campaign.
4. Fayetteville Artificial Intelligence SMS Messaging Terms

When you separately opt in, you may receive text messages relating to your inquiry, appointment or demo scheduling, reminders, requested service information, customer support, service updates, account notices, follow-up communications, and promotional offers when you have expressly consented to promotional messaging.
- Voluntary consent: Consent to receive SMS messages is not a condition of purchasing goods or services.
- Message frequency: Message frequency varies depending on your requests, account activity, and the program you join.
- Rates: Message and data rates may apply. Your mobile carrier determines those charges.
- Opt out: You may cancel SMS service at any time by replying STOP. After you send STOP, we may send one confirmation message, and you will no longer receive messages from that program unless you opt in again.

5. AI, Automated Systems, and Third-Party Services
Some services use artificial intelligence, automated routing, chat, voice, scheduling, communications, hosting, analytics, social platforms, or other third-party technology. AI-generated or automated output may be incomplete, inaccurate, or inappropriate for a particular decision and must be reviewed by a responsible person before reliance or publication.
We do not control third-party platforms and are not responsible for their outages, policy changes, account restrictions, content moderation, pricing changes, or service interruptions. Your use of third-party services may also be governed by their terms and privacy policies.
6. Intellectual Property and Customer Content
You retain ownership of original content that you provide, subject to the rights needed for us to perform the services. You grant us a limited license to host, reproduce, adapt, and display that content for your project and to provide the requested services.
Unless a separate written agreement states otherwise, Fayetteville Artificial Intelligence retains ownership of its pre-existing materials, methods, prompts, software, templates, systems, design components, automation logic, know-how, and improvements. Subscription-based sites, apps, agents, and systems may remain managed technology made available only while the subscription is active.
7. Confidentiality
Each party will use reasonable care to protect non-public business information received from the other and will use it only for the relationship, except where disclosure is authorized, required by law, or reasonably necessary to service providers supporting the work.
8. No Guarantee; Disclaimer of Warranties
Services are provided on an "as is" and "as available" basis to the fullest extent permitted by law. We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Nothing in these Terms excludes a warranty that cannot legally be excluded.
9. Limitation of Liability
To the fullest extent permitted by law, Fayetteville Artificial Intelligence will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits or revenue; lost data; loss of goodwill; or damages resulting from third-party platforms, customer content, unlawful messaging, or decisions made from AI output.
To the fullest extent permitted by law, our total liability arising from a claim will not exceed the amount you paid us for the specific service giving rise to the claim during the three months immediately before the event giving rise to liability. This limitation does not apply where prohibited by law.
10. Suspension and Termination
We may suspend or terminate access for nonpayment, unlawful activity, security risk, misuse, violation of these Terms, or conduct that could harm customers, third parties, carriers, platforms, or our business. Provisions that by their nature should continue after termination will survive, including payment obligations, ownership provisions, disclaimers, and limitations of liability.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Any legal action that is not required to be handled through another agreed process must be brought in a court of competent jurisdiction serving Cumberland County, North Carolina, and the parties consent to that venue.
12. Changes and Severability
We may update these Terms by posting a revised version on this page. Changes apply prospectively from the stated effective date. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver.
